Cosmicnode Terms of Service

Welcome to Cosmicnode Infinity Platform!

Thank you for choosing Cosmicnode’s Connected IoT SaaS Platform services. Please read this Terms of Service Agreement (“Agreement”) carefully before using our platform. By accessing or using our services, you agree to be bound by the terms outlined below. If you do not agree with any part of these terms, you must not use our services.

1. Acceptance of Terms

1.1 This Agreement is between you or the entity you represent (the “User”) and Cosmicnode B.V. (“Cosmicnode”) with its registered office in High Tech Campus 27, 5656 AE, Eindhoven, Netherlands. It governs your access to and use of Infinity Platform, Cosmicnode’s Connected IoT SaaS platform, including but not limited to mobile applications, web portals, APIs, cloud services, and connected smart devices. By accessing or using Infinity Platform, you acknowledge that you have the authority to bind yourself or the entity you represent to this Agreement and agree to comply with its terms.

1.2 By registering an account, using our platform, or accessing any services, you acknowledge and agree to comply with all terms, including any updates posted on our website.

1.3 Cosmicnode reserves the right to update, modify, or terminate this Agreement at any time. Changes will be announced on our official website. Continued use after changes indicates acceptance.

2. Definitions

2.1 “Infinity Platform” refers to Cosmicnode’s Connected IoT SaaS Platform, which enables users to connect, monitor, and control smart devices and appliances, whether internet-connected or non-internet-connected. Platform includes mobile applications, web portals, APIs, cloud services, and connected smart devices.

2.2 “Licensed Software” refers to the proprietary software developed by Cosmicnode for IoT device connectivity, management, and analytics.

2.3 “Services” include cloud-based device management, automation, analytics, API integrations, mobile applications, and other IoT SaaS functionalities.

2.4 “IoT Devices” refers to the hardware products that are connected and managed via Infinity Platform, including both internet-connected and non-internet-connected smart devices.

2.5 “Smart Devices” refer to appliances and electronic systems that Infinity Platform can monitor and control, regardless of whether they are connected to the internet.

3. Scope of Services

3.1 Infinity Platform provides an IoT SaaS platform that allows users to connect, monitor, and control smart devices and appliances over the cloud or through local network integrations.

3.2 Users may access features such as device onboarding, automation, analytics, notifications, and third-party integrations.

3.3 Certain functionalities or access to the Infinity Platform may be restricted due to external requirements or legal provisions applicable in specific geographical regions and on certain device platforms. As a result, Cosmicnode does not guarantee the availability of the Infinity Platform in all geographical regions or on all device platforms.

3.4 Cosmicnode reserves the right to modify or discontinue any part of the service, including feature enhancements and software updates.

4. License and Restrictions

4.1 Grant of License: Cosmicnode grants you a non-exclusive, non-transferable, revocable license to use Infinity Platform for your IoT applications.

4.2 Restrictions: Users shall not:

  • Reverse-engineer, modify, or distribute the software without prior authorization.
  • Use the platform for illegal activities or unauthorized data collection.
  • Lease, sublicense, or transfer the software to third parties.
  • Interfere with the security of the platform, including attempting unauthorized access.

4.3 Unauthorized use may result in account suspension or legal action.

5. User Responsibilities

5.1 Account Security: Users must safeguard their credentials. Any unauthorized use of an account must be reported immediately to Cosmicnode.

5.2 Compliance: Users must ensure that their use of the platform adheres to applicable laws, including data privacy and security regulations.

5.3 Device Compatibility: Cosmicnode is not responsible for any damages resulting from unauthorized device integrations or unsupported hardware.

6. Third-Party Software & Services

6.1 Infinity Platform may integrate third-party software, APIs, or cloud services to enhance functionality.

6.2 Cosmicnode is not responsible for third-party software & service failures, data loss, or disruptions caused by external providers.

6.3 Users acknowledge that Cosmicnode may change third-party providers at its discretion.

7. Privacy & Data Protection

Please refer to Cosmicnode’s Privacy Policy published on the Cosmicnode website 7.1 Cosmicnode collects and processes user data in accordance with its Privacy Policy, which details data handling, storage, and security measures.

7.2 Users must not collect or process personally identifiable information (PII) of third parties without consent.

7.3 Cosmicnode does not claim ownership of user data but may use anonymized data for service improvements and analytics.

8. Service Limitations and Liabilities

8.1 Infinity Platform does not guarantee uninterrupted or error-free services and is not liable for disruptions due to external factors such as internet outages or cyberattacks.

8.2 Force Majeure: Cosmicnode is not responsible for service failures caused by unforeseen events, including but not limited to natural disasters, power failures, regulatory changes, or network disruptions.

8.3 Users acknowledge and accept that scheduled downtime may occur for software updates, bug fixes, and maintenance activities necessary for platform stability and security. Additionally, Cosmicnode is not responsible for service interruptions caused by cloud platform service providers or other third-party dependencies beyond its control.

9. Suspension & Termination

9.1 Cosmicnode reserves the right to suspend or terminate access to Infinity Platform if a user:
  • Violates the terms of this Agreement.
  • Engages in activities that compromise platform security or user privacy.
  • Fails to comply with legal or regulatory requirements.
  9.2 Upon termination, users must cease all use of Infinity Platform and delete any associated data or software.

10. Governing Law & Dispute Resolution

10.1 These Terms of Service are governed by and shall be interpreted in accordance with the laws of The Netherlands. You acknowledge and agree that any disputes, claims, or legal proceedings arising from or related to these Terms of Service, your use of this IoT Platform, or the website, including disputes regarding their validity or existence, shall fall under the non-exclusive jurisdiction of the courts in Amsterdam, The Netherlands. However, you expressly consent to submit any such disputes, claims, or legal actions exclusively to the courts of Amsterdam, The Netherlands

10.2 In the event of a dispute, both parties agree to first attempt an amicable resolution. The language to be used in the arbitral proceedings shall be English. If unresolved, disputes shall be settled through arbitration in Amsterdam, The Netherlands.

11. Copyright and Trademarks

All content, software, designs, and materials available through Infinity Platform are owned or licensed by Cosmicnode B.V. and are protected under international copyright laws. Users may not reproduce, modify, or distribute content without prior written consent. The following are trademarks of Cosmicnode B.V.:

  • HortiControls
  • Infinity Controls
  Unauthorized use of these trademarks is strictly prohibited. Third-party trademarks referenced remain the property of their respective owners.

Quality of Service(QoS)

The best-in-class Quality of Service (QoS) – bandwidth and latency for a wireless mesh network depends on the specific application. Cosmicnode wireless mesh network designed for high-performance applications such as real-time control and monitoring.

Over-the-Air (OTA) firmware update

supports device Over-the-Air (OTA) firmware updates over the mesh network. This means that firmware updates can be pushed to all devices on the network without the need to manually update each device individually. OTA can be performed even if some of the devices on the network are offline.

Bi-directional communication

Near real-time bidirectional communication is a type of communication that allows data to be transmitted and received in both directions with minimal latency. This makes it ideal for applications where it is important to have a quick response time, such as real-time control and monitoring.

Efficiency & Collision Avoidance

Cosmicnode wireless mesh network uses a proprietary routing algorithm designed for efficiency and collision avoidance. This algorithm is based on a number of factors, including the distance between nodes, the quality of the links between nodes, and the current traffic load on the network. It is designed to find the most efficient path for data packets to travel. 

No Single Point of Failure

All mesh nodes in a network can communicate with each other directly, without the need for a central bridge or coordinator. This decentralized communication structure makes mesh networks highly resilient to failures and capable of scaling to large numbers of nodes. Every mesh node can be configured as a transmitter and a receiver, and can forward data packets to other nodes in the network.

Lowest single hop latency

Cosmicnode wireless mesh network has a single hop latency of 15ms. This is the time it takes for a data packet to travel from one mesh node to another. This is a very low latency, which makes Cosmicnode ideal for applications such as real-time control and monitoring.
  •   Efficient routing algorithms: Cosmicnode uses efficient routing algorithms to quickly find the best path for data packets to travel.
  •   Adaptive channel selection: Cosmicnode uses adaptive channel selection to choose the best channel for data transmission based on current conditions.

Highly reliable and scalable

A distributed, highly reliable, scalable, and bidirectional wireless mesh network is a type of network that is designed to be resilient to failures and to be able to handle a large number of devices. It is also designed to be able to communicate in both directions, which makes it ideal for applications such as real-time control and monitoring.

Multi Radio Technology BLE and 2.4GHz

Cosmicnode wireless mesh network uses BLE and 2.4GHz in a complementary way. BLE is used for low-power communication and mesh networking, while 2.4GHz is used for high-bandwidth communication. This combination of technologies allows the Cosmicnode wireless mesh network to provide a highly reliable, low latency, and scalable solution for a wide range of applications. BLE BLE is a low-power wireless technology that is well-suited for wireless mesh networks. BLE has a number of advantages for mesh networks, including:
  •  Low power consumption: BLE devices consume very little power, which is important for mesh networks where devices may be battery powered.
  •  Short-to-mid range: BLE devices can have a range of up to 100 meters in ideal conditions. This makes BLE suitable for mesh networks where devices may be spread out over a large area.
  •  Mesh networking support: BLE supports mesh networking out of the box, making it easy to create mesh networks with BLE devices.  
2.4GHz 2.4GHz is a high-bandwidth wireless technology that is well-suited for applications that require high data throughput. 2.4GHz has a number of advantages for mesh networks, including: High bandwidth: 2.4GHz devices can support data rates of up to 250 kbps. This makes 2.4GHz suitable for mesh networks where devices need to transfer large amounts of data, such as real-time video or audio. Long range: 2.4GHz devices can have a range of up to 1000 meters in ideal conditions. This makes 2.4GHz suitable for mesh networks where devices may be spread out over a large area.

System Integrators and Installers

Cosmicnode lighting control system is easy to install and commission. Integration with wide range of lighting control products and accessories from different manufacturers and vendors. Offer third party integration API’s and gateways (supported protocols Modbus, SDDP, MQTT, Rest API). Mobile app SDK for custom app development or integration to existing app eco-system.
